The Japan Hydrographic Association, a juridical foundation (hereinafter referred to as "the Association"), will operate this web site (hereinafter referred to as "the site") for the purpose of providing information on introduction and sale of various products of the Association to a customer (hereinafter referred to as "the customer") using the site for his/her private purpose.
Whenever making an access to the site or using the site, the customer is subject to entirely observe the following rules as well as any other laws concerned.
When accessing to and viewing the site, or when purchasing any product subsequently, the customer is deemed to have agreed to these rules, and requested to peruse these rules carefully.
1. Personal Information
The contents of the personal information protection policy of the Association will be applied to the customer at the time of using the site. Accordingly, it is requested for the customer to read and comprehend the contents fully.
The Association encodes any internet communication of the customer's personal information by applying SSL (Secure Socket Layer) technique.
2. Intellectual Property Right
All the contents included in the site, e.g. letters, images, software, etc. are of the intellectual property rights of the Association or the supplier of the contents. Copyrights, trademark rights and all other intellectual rights belong to the Association or the supplier of the contents unless otherwise provided.
3. User ID and Password
In case of using the site, the responsibility for maintaining the secrecy of the customer's user ID and password and for limiting the access to the computer rests upon the customer. The customer is also subject to agree to the recognition of the responsibility for everything to be done by using his/her own user ID and password.
4. Method of Contact
Any contact with the customer regarding inquiry, notification, consultation on payment method and/or delivery method, etc. will be made by means of telephone, facsimile, e-mail, etc.
5. Explanation on Products
The Association is exerting utmost efforts to keep the accurateness of the explanations of products on the site. However, the Association may not always be able to guarantee that the explanation on any product or other contents in the site is complete, up-to-date or errorless. If the customer considers that the product supplied by the Association is not the same as explained, the customer is requested to make a contact with the Association.
6. Price of Product and Supplementary Expenses
The price of a product includes a consumption tax. However, no consumption tax is levied on any product to be forwarded overseas. Supplementary expenses, i.e. postage or carriage, package fee, bank transfer charges, C.O.D. fee and/or fee for settlement at a convenience store, are required to be paid additionally.
7. Limitation of Purchase
The upper limit quantity of a single item at a purchase is 20 pieces.
The upper limit sum of money at a purchase is 300,000 yen. However, this limit will not be applied to the case of settlement of payment by bank payment (advance payment) and by credit card.
8. Postage, Carriage and Package Fee
The amount of postage, carriage or package fee will be different according to the kind of product, quantity, packing style, forwarding agent, delivery addressee, etc. For details, it is requested to look at the pages of forwarding rates in the User's Guide.
9. Method of Payment and Forwarding
Payment of product price can be made either by means of a credit card, bank transfer, Collect on Delivery (C.O.D.: available only in Japan) or settlement at a convenience store (available only in Japan).
- In case of the payment by a credit card, a bill for the ordered product will be sent through the credit card company to the customer after the product ordered is forwarded. The frequency of payment will be confined to one time.
- In case of the payment by bank transfer, the customer is requested to transmit the payment to the bank account designated by the Association within 5 business days after the order is placed. Upon confirming the money received at the designated bank account, the Association will forward the product ordered.
- In case of C.O.D. by a forwarding agent, the product will be delivered in exchange of the money by the customer.
- In case of settlement at a convenience store, the customer will pay the amount of money at one of the stores of designated convenience-store chains within 5 business days after placing the order. Upon confirming the money received at the designated bank account, the JHA will forward the product ordered.
- In case of payment in installment, the JHA will consult with the customer on the method of payment.
- Any product ordered by the noon on a working day (From Monday to Friday, except national holidays) will be dispatched on the same day, and thereafter on the next working day. However, occasionally delivery may take some more time in such cases where the Service Center contacts the customer to confirm the contents of order or to inform that the product is out of stock.
10. Conclusion of Sales Contract
When an order is placed at the site, ''Confirmation of Order' message will be e-mailed from the site to the customer indicating the confirmation of the order and the content(s) of the product(s) ordered. Any order from the customer will constitute an application to the contract for purchase of product. In case of an order is placed to any product sold at the site, the acceptance of the order by the Association will be regarded as a conclusion of the sales contract as and when a message ''Forwarding of Product(s) Ordered' is e-mailed to the customer. In case where multiple products are ordered in a single order sheet, such product(s) not confirmed in the ''Forwarding of Product(s) Ordered' message are not included in the object(s) of the contract to be concluded by such e-mail message.
11. Delay in Forwarding
The Association is exerting its efforts to expedite the forwarding of the products when an order is received from the customer. However, in such cases as force majeure, system trouble or any other unforeseeable situation, forwarding may be delayed. When it is expected that the forwarding may be considerably delayed, the Association will contact the customer to inform of the situation for consultation on taking any appropriate countermeasure.
12. Cancellation of Order
After receiving any order from the customer, the Association may cancel the order from the following reasons:
- As a result of checking the credit card by the credit card company, the use of the card is not accepted.
- Any false fact is recognized in the customer's personal information.
- An order is placed for any product warehousing of which is not determined for a long time or production of which is already finished.
- Any contact is received from the customer to change or withdraw the order.
- For any other reason the Association particularly recognize the cancellation of the order.
13. Exchange or Return of Product and Repayment
Exchange or return of product(s) will be feasible within 8 days including the day when the product(s) are received by the customer. The postage or carriage for returning the product will be borne by the customer. In case of returning the product due to any defect or any other fault of the Association, the postage or carriage will be borne by the Association.
Repayment will be made upon confirmation of the returned product. The full amount of the payment will be reimbursed in the case of a flawed product or wrong product, while the repayment will cover only the price of product in the case of the customer's cause.
14. Responsibility for Linked Sites
The Association will assume no responsibility for the contents of any other web sites linked to the site.
Also, the Association will assume no liability against any loss or damage caused by using such other web sites.
15. Operation of the Site
In order to operate the site in good condition, the Association may stop operation of the site without any prior notification. Also, the Association may add, correct or suspend the service in the site without any prior notification..
16. Amendment to Rules
The Association will be able to amend the Rules at any time. After the amendment, the customer will be bound by the amended terms, so that the customer is urged to open this page to review the latest terms whenever starting a transaction.
17. Proper Law and Competent Court
The enforcement possibility, interpretation and effectiveness of the Rules shall be judged under the provisions of the Japanese laws. For any dispute regarding the Rules, the Tokyo District Court will be designated as the competent court.
